WEDDING TERMS AND CONDITIONS – PLEASE READ

 

OWNERSHIP RIGHTS AND RESPONSIBILITES

The Photographer and Client agree that unless stated otherwise in this document, The Photographer owns any and all copy or reproduction rights. Client agrees to not reproduce or copy any proof or other photographs of the event, taken by the Photographer, without the Photographer’s written permission unless it is for non-commercial use. Any unauthorised reproduction of proofs or failure to return proofs to Photographer (if applicable), constitutes a breach of this agreement.

PAYMENT REQUIREMENTS

To reserve the event date, the Photographer requires a booking fee of £200; The Photographer will not hold any date open without receipt of said payment. Said payment is non-refundable for any reason, except if the Photographer cancels this contract.

The remaining balance must be received by photographer on the date of viewing the proofs or within 28 days of wedding date, whichever is sooner.

CANCELLATION

If the Photographer has to cancel this contract for reasons beyond their control (death, injury, sickness etc.) their liability shall be limited to a full refund of all monies paid including the scheduling payment.

If client(s) has have to cancel this contract for any reason after a period of 14 days from the date of signing this contract, as compensation for loss of income the following charges apply as a percentage of the total fee due. 60 days or less – 100%, 61- 90 days –75%, 91-120 days – 50% (number of days before the wedding). If client(s) cancel between 14 days from the signing of this contract and 121 days before the wedding, the scheduling payment will be retained by the photographer.

Should the said wedding be a postponement, then, subject to availability, all money paid may be applied to the new wedding.

PROVISIONS

The Photographer will take a break from photographing during the sit-down part of the meal. If any of the venue(s) do not have free and ample parking, client(s) are responsible for informing photographer of this and providing any permits or tickets that are required on the day for parking purposes.

RIGHT OF ASSIGNMENT

The Company retains the right to assign the supply of the product(s) or service(s) to the Customer to another suitable company should they be unable to complete these terms and conditions.

EXCLUSIVITY

It is understood that SymplyPhotography will act as the sole and exclusive wedding photographer.

FORCE MAJEURE OR ACT OF GOD

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

DISCLAIMER

The Photographer agrees that every effort will be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to the Photographer’s equipment or transport and the Photographer is unable to provide Client with the agreed upon photography services and/or products, The Photographer’s liability shall be limited to a full refund of all monies paid. Photographer has full Public Liability, and professional indemnity insurance. The Photographer and Client agree that the Photographer is not responsible for any damages, emotional or otherwise.

While all reasonable care will be taken to fulfil the wishes of the client, no financial responsibility over and above the sum of monies received by the Photographer is an amount to be claimed against in the event of malfunction or theft of equipment, films, digital files, etc.

Client(s) agree that the Photographer may use any photograph for publicity purposes. Such publicity and advertising may include publication on the Photographer’s website, or any social media environment.

The Photographer cannot be responsible for unusable shots due to distractions from Client’s guests (i.e. eyes being closed) and other circumstances beyond the Photographers control. The Wish List is deemed to be a wish list and not a contracted list.

The Photographer is not responsible for goods not picked up or delivery arranged for beyond six months after their completion. In the unlikely event of a complaint, any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.

PRODUCTS AND DELIVERABLES

If Clients package includes the images on DVD, these shall be provided as original resolution final edited jpeg images, unless specified otherwise.

In the unlikely event that album images have not been selected and/or the final album design has not been signed off by the client within a 12 month period from the date of the event, we reserve the right to add a surcharge to reflect any increases in album manufacturing costs, or increases in VAT.

All deliverables, with the exception of online deliverables, will be provided together once the final deliverable is with the photographer. Clients agree to collect deliverables from the Photographer. Where this is not possible, the Photographer will organise suitable courier delivery of products and deliverables, the cost of which is to be met by the Client.
